Terms of Service

By creating an account with Savvy on the Service, you agree to subscribe, free of charge, to receive newsletters, marketing or promotional materials and other information any of the Companies may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at hello@savvywealth.com. 

If you wish to purchase any product or service made available for purchase through the Service ("Purchase"), including a Paid Subscription, you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.

1. Eligibility: All persons with an account with Savvy are eligible to participate in the referral program as referrers. No employee or contractor of Savvy or its affiliates is eligible regardless of status.

‍2. Referrer Donations: For each successful referral, Savvy will donate $500 to the charity chosen by the referrer. Savvy reserves the right to approve or reject the charity the referrer selects. If Savvy is unable to donate to a particular organization, the referrer will be requested to choose a different charity or from a list of alternative options provided by Savvy. Wherever possible, donations will be made on behalf of the referrer. The donations will be made following the referral meeting the definition of successful referral below.

‍3. Successful Referral Definition: A successful referral is defined as a person who at the time of the referral to Savvy is not or in the past has been a client of our affiliate Advisors, Inc. (“Advisors”) , if after such referral to Savvy by referrer, the prospect opens an investment management account with Advisors and maintains an active status for at least three months.

‍4. Discounts: As of the effective date of these Terms, any person who becomes a successful referral –will receive from Advisors a one-time fee discount of up to $500 on their investment management fees payable to Advisors. Fee discount will be applied to the first invoice after the referral's first complete calendar quarter with Advisors. If the invoice amount is less than the fee discount for the quarter, the invoice will be waived. Advisor may discontinue offering such discount at any time.

‍5. Referral Outreach: By providing the referral information, the referrer is consenting to their name being used by Savvy and/or Advisors in its outreach to their respective referrals.

‍6. Discretion:  Savvy and Advisors have the discretion to turn down a referral for any reason including, but not limited to, the prospect 's financial objectives or circumstances not aligning with the expertise and capabilities of Advisor’s offerings.

‍7. Program Expiration or Modification: Savvy reserves the right to terminate or modify the Savvy Referral Program, including the list of eligible charities, at any time without prior notice.

‍8. Disputes: Any disputes or questions regarding the referral program should be directed to Savvy’s Client Service team at client-service@savvywealth.com.  For full terms and conditions of the Savvy Referral Program, please visit our website or contact our Client Service team.

Savvy in its sole discretion and at any time, may modify subscription fees for any materials or services made available by the Service as a Paid Subscription. Any Paid Subscription fee change will become effective at the end of the then-current Billing Cycle.

Savvy will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Paid Subscription before such change becomes effective.

Your continued use of a Paid Subscription after a Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Except when required by law, paid Subscription fees are non-refundable.

Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using any of Company, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into the Agreements and abide by all of the terms and conditions of Terms. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of the Service.

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with the Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

The Service and original the Content of the Companies (excluding Content provided by users), features and functionality are and will remain the exclusive property. as applicable of Savvy, the other Companies and their respective licensors. The Service and such original Content is protected by copyright, trademark, and other laws of the United States. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Savvy Wealth, Inc..

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights ("Infringement") of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to dmca@savvywealth.com, with the subject line: "Copyright Infringement" and include in your claim a detailed description of the alleged Infringement as detailed below, under "DMCA Notice and Procedure for Copyright Infringement Claims"

You may be held accountable for damages (including costs and attorneys' fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through the Service on your copyright.

You may provide us either directly at hello@savvywealth.com or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to the Service ("Feedback"). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Savvy may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Savvy is not under any obligation of confidentiality with respect to the Feedback. In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant the Companies an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of State of New York without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The Agreement constitute the entire agreement between us regarding the Service and supersede and replace any prior agreements we might have had between us regarding the Service.

We reserve the right to withdraw or modify the Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entirety of the Service, to users, including registered users.

We may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

No waiver by Savvy of any term or condition set forth in Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Savvy to assert a right or provision under Terms shall not constitute a waiver of such right or provision.

If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.
